Please find attached herewith a formal Statutory Complaint and Demand Notice on behalf of the RTI Activists Association, Assam State Committee, addressed to the Additional Chief Secretary, Department of Panchayat and Rural Development (P&RD), Government of Assam.
This complaint pertains to a multi-layered financial syndicate involving public servants, block technical staff, and empanelled vendors (including MEHEK ENTERPRISE and J.M. ENTERPRISE) operating in Darrang District. A forensic scrutiny of certified official records obtained under the RTI Act, 2005 (spanning Pages 1 to 52) has unearthed severe criminal elements, including:
1. Forgery and Manipulation: Financial transactions executed on un-dated instruments (violating Rules 50 and 229 of the Assam Financial Rules) and chronological fabrication of statutory RTI records.
2. Tax Fraud: Fabricated, mathematically impossible GST entries and gross structural discrepancies between words and figures on invoices to draw inflated public funds.
3. Double-Billing Syndicate: Direct replication, cloning, and re-submission of identical material vouchers to siphon off public exchequer money under multiple MGNREGA schemes.
4. Estimation and Rate Inflation: Unauthorized alteration of units from Technical Sanction (TS) and criminal inflation of market rates (e.g., Cement listed at Rs. 8,500/- per bag against standard SOR).
Statutory Invocation and Formal Demands:
The attached petition details clear prima facie violations under Sections 61, 316, 318, 336, 340, and 342 of the Bharatiya Nyaya Sanhita (BNS), 2023, along with Section 13 of the Prevention of Corruption Act, 1988.
We formally demand an immediate administrative freeze on payments to the implicated vendors, the constitution of an independent Special Investigation Team (SIT) external to Darrang district, and immediate prosecution sanction against the complicit Block Development Officer (BDO), Accredited Engineers, and Gram Panchayat Secretaries.
Please note that if the department fails to register an official FIR within 15 days of receipt of this statutory complaint, our association will be legally compelled to approach the Hon'ble Gauhati High Court via a Public Interest Litigation (PIL) / Criminal Petition for a judicially monitored probe by the Directorate of Vigilance and Anti-Corruption, Assam or the Central Bureau of Investigation (CBI).
